Eligibility
- H-1B: Job in a specialty occupation (typically bachelor’s or higher); employer sponsorship.
- L-1: Transfer from a related foreign company; executive, manager, or specialized knowledge.
- Offer: Valid job offer from a US employer willing to sponsor and file the petition.
- Qualifications: Education and/or experience that meet the job requirements.
- Licence: Professional licence if required for the occupation (e.g. medicine).
Required Documents
- Valid passport.
- Form I-129 (Petition for Nonimmigrant Worker) filed by employer with USCIS.
- Labour condition application (LCA) for H-1B, certified by DOL.
- Degree certificates, transcripts, and/or experience letters.
- Job offer letter and description of job duties and requirements.
- Once petition is approved: DS-160, visa fee, and passport for consular interview.
Application Process
- US employer files a petition (e.g. I-129 for H-1B/L-1) with USCIS; H-1B may require cap registration first.
- If applicable, obtain certified Labour Condition Application from the Department of Labour.
- USCIS adjudicates the petition; premium processing may be available.
- Once approved, apply for the visa at a US embassy/consulate (DS-160, fee, interview).
- Attend the visa interview with passport and supporting documents.
- If granted, enter the US with your visa and Form I-797 approval notice.
